NEW DELHI: Supreme Court on Friday issued notice to Karnataka govt and deputy chief minister D K Shivakumar, seeking their response on a Central Bureau of Investigation (CBI) plea challenging the state govt's decision to withdraw its consent to the agency to investigate a disproportionate assets (DA) case against him.
A bench of Justices Surya Kant and Ujjal Bhuyan agreed to examine the CBI's petition challenging the Karnataka high court (HC) order which rejected its plea.
The Siddaramaiah-led Congress govt in Karnataka had on Nov 23 last year held that the previous BJP govt's 2019 decision to give consent to the CBI to investigate the disproportionate assets case against Shivakumar was not in accordance with the law, and withdrew the sanction.
The Karnataka high court had held as "non-maintainable" the petition filed by CBI and BJP MLA Basanagouda Patil Yatnal challenging the Congress govt's decision to withdraw the consent.
